TITLE
I wanna try something, yeah something. Maybe write things that I've learn and share it with other people. So lets start, Bismillah
As you know a title or also known as geran is a very important document to show the ownership of that particular land. When you have the title of land it means you have an exclusive right on that land. So there is a few elements that we should know because every title might have different type when it come to its content. Such as the type of land title, type of land ownership, categories of land use and the restriction of that land itself.
So the first one is type of land title. Title been divide into two, qualified title and final title. Let me explain about the qualified title first. Qualified title is issued by local authority but the boundary(sempadan) of the land is still tentative and not been surveyed by the registered land surveyor yet. Due to that the land cannot undergo amalgamation (gabungan tanah), sub-division (pecah bahagi) and partition (tanah dibahagi kpd beberapa bahagian). While for the final title, the land boundary is fixed because this land been surveyed by registered land surveyor and of coz this land can undergo amalgamation, sub-division and partition. It is vice versa actually.
The reason why qualified title been issued by the authority although it's still not been surveyed by the registered land surveyor because using this title it show the ownership of owner on that land. Besides,by the presence of that title the owner can do any dealings with that land. For example, the owner can sell the land to other people without commit anything against the law.
Now we move on to the type of land ownership or also know as interest of land. There are also two type interest of land which are freehold and leasehold. For freehold land it means the tenureship of that land is for perpetuity (selamanya), you gonna be the owner of the land forever unless you sell it to other people. While for leasehold land, the tenureship of land will be in certain terms for example 33 years, 66 years and 99 years. During the expired date of that land, the land will be revert back to the local authority.
Furthermore the title can be registered under Land Office (Pejabat Tanah) and Registrar's Office (Pejabat Tanah dan Galian) based on the land's characteristic. Land that registered as Land Office Title it is a country land that less than 4 hectares and also land that registered as land settlement ( eg FELDA, FELCRA). For title registered as Registrar's Office Title is a town land, village land, country land more than 4 hectares, sea-bed and foreshore.
Based on National Land Code Act 1985 there is only 3 category of land; agriculture, industry and building. All this land have its own implied condition, and this implied condition is not written on the title. You have to chekidout by yourself. While for the express condition its been written in the title. The restriction of land also usually written in the title...
